This Terms of Use Agreement (“Agreement”) explains your rights and obligations in using the website operated by Felvior LLC (“Felvior,” “we,” “us,” or “our”). The website and all activities conducted through it constitute the “Service” or the “Services.”

Please read this Agreement carefully. By accessing or using the website, you confirm that you have read, understood, and agreed to be bound by this Agreement.

To the fullest extent permitted by applicable law, you agree that access to and use of the Services is at your sole risk. The Services are provided “AS IS” and “AS AVAILABLE,” without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

Felvior does not warrant that the Services will be uninterrupted, error-free, secure, or completely accurate at all times.

 

SUBJECT TO CHANGE

Felvior reserves the right to modify, suspend, or discontinue the Services, in whole or in part, at any time. Where required by law, reasonable notice will be provided.

 

SOLE CONSIDERATION

You acknowledge that Felvior’s sole obligation in connection with the Services is to provide access to them as offered or as modified by Felvior in its sole discretion.

 

GOVERNING LAW

This Agreement shall be governed by and construed in accordance with the laws of the United States and the State of Texas, without regard to conflict-of-law principles.

 

DISPUTE RESOLUTION – ARBITRATION & NO CLASS ACTIONS

You agree that any dispute arising out of or relating to the Services or this Agreement shall be resolved through binding individual arbitration, except where prohibited by law.

You agree that:

  • Claims may only be brought on an individual basis

  • You waive any right to participate in class, collective, or representative actions

Arbitration shall be administered by the American Arbitration Association (AAA) or another nationally recognized arbitration provider if AAA is unavailable.

 

YOUR RESPONSIBILITY

You are solely responsible for your use of the Services and for compliance with all applicable laws and regulations.

You agree to indemnify and hold harmless Felvior LLC, its officers, employees, contractors, service providers, vendors, and agents from any claims, damages, liabilities, losses, or expenses (including reasonable attorneys’ fees) arising from your use or misuse of the Services or violation of this Agreement.

 

STANDARD OF CARE

Felvior will exercise reasonable care in providing the Services. Except to the extent prohibited by law, Felvior shall not be liable for damages arising from ordinary operational issues or third-party service failures.

 

LIMITATION OF LIABILITY

To the maximum extent permitted by applicable law:

  • Felvior shall not be liable for any indirect, incidental, consequential, special, or punitive damages, including loss of profits or data.

  • Felvior’s total liability shall not exceed the amount paid by you to Felvior for the transaction giving rise to the claim.

 

CIRCUMSTANCES BEYOND OUR CONTROL

Felvior is not responsible for delays or failures caused by circumstances beyond its reasonable control, including but not limited to internet outages, carrier delays, third-party service disruptions, cyber incidents, or errors in information provided by third parties.

 

TERMINATION

Felvior reserves the right to suspend or terminate access to the Services at any time for violation of these Terms, unlawful activity, or misuse of the Services. Termination does not affect rights or obligations accrued prior to termination.

 

CONTESTS, PROMOTIONS & SWEEPSTAKES

Any contests, promotions, or sweepstakes offered by Felvior are subject to separate rules. Unless otherwise stated:

  • Promotions are void where prohibited by law

  • Participants must be 18 years of age or older and legal U.S. residents

  • Felvior is not responsible for technical or transmission failures

  • Odds of winning depend on the number of eligible entries

  • Employees of Felvior are ineligible to participate

 

MOBILE TERMS OF SERVICE

If you opt in to receive SMS or text messages from Felvior:

  • Message and data rates may apply

  • Message frequency varies

  • Consent is not a condition of purchase

  • You may opt out at any time by replying STOP

AMENDMENTS

Felvior may update these Terms at any time. Continued use of the Services after changes are posted constitutes acceptance of the updated Agreement. If you do not agree, your sole remedy is to discontinue use of the Services.
